PERSONAL DATA PROCESSING TERMS AND CONDITIONS
The use of this mobile app is subject to the Privacy Policy in force at any given moment, the user/customer undertaking to read this text carefully prior to giving his/her consent for the collection and processing of personal data and confirm his/her agreement with it.
These Personal Data Processing terms regulate the collection and processing pf personal data provided by “LOJA DAS MEIAS” customers in the “Customer Contact Form” and the exercise of Customers’ rights regarding any such provided data under the terms of the Data Protection Law currently in force.
I- Costa & Filhos, Lda., a limited liability company, with registered office in Rua Castilho, no. 39, 7º AP, 1250-068 Lisboa, registered at the Lisbon Commercial Registry under registration and corporate taxpayer number 500 078 386, with a share capital of €450.000,00 (four hundred and fifty thousand Euros), is the owner of the brand “LOJA DAS MEIAS”.
II- The personal data provided in the “Customer Contact Form” will be processed by Costa & Filhos, Lda. and Nazareth & Calleia – Importação e Exportação, Lda., a limited liability company, with registered office in Av. Valbom 4, 2750-508 Cascais, registered at the Cascais Commercial Registry under registration and corporate taxpayer number 503 362 581, these two companies being responsible for the data collection and processing (hereinafter also referred to as the “Responsible Companies”).
III- As the entities responsible for the data processing, Costa & Filhos, Lda. and Nazareth & Calleia – Importação e Exportação, Lda. value the importance of protecting their customers’ personal data of whichever nature it may be, and consequently developed a number of security measures to protect the personal data thus provided.
CUSTOMER’S PERSONAL DATA PROCESSING
IV- The client/owner of the data has been informed and expressly authorizes Costa & Filhos, Lda. and Nazareth & Calleia – Importação e Exportação, Lda. to proceed to the collection and processing of his/her personal data solely for the purposes indicated in paragraph V. below.
V-The personal data provided through the mobile app and the "Customer Contact Form" will be collected and processed as appropriate, relevant, and limited to what is necessary for the following purposes:
a) Communication by e-mail, SMS or phone of any sales, promotions and other “Loja das Meias” events;
b) Comunication by e-mail, SMS or phone of commercial information regarding promotions and campaigns and events relating to brands which Costa & Filhos, Lda. and Nazareth & Calleia – Importação e Exportação, Lda. represent;
c) Information on products sold by the companies operating under the brand name LOJA DAS MEIAS and other brands represented by these companies;
d) Customer management;
e)Development of targeted marketing actions, as well as consumer profile analysis and customer loyalty development strategies.
VI-Should a customer provide any third party personal data, he/she will be responsible for providing it and for obtaining the latter’s consent for the purposes described herein.
VII-The client hereby declares to have been specifically informed of the following:
THE CONCEPT:
The personal data concept refers to any information relating to an individual who is identified or identifiable, directly or indirectly, in particular by reference to an identifier, such as a name, an address, an email, an identification number, location data, electronic identifier or to one or more identity elements including physical, genetic, physiological, mental, economic, cultural or social concerning this individual.
TIMELINESS AND ACCURACY
Your personal data should be communicated accurately and permanently kept up to date. You therefore undertake to keep the Responsible Companies (Costa & Filhos, Lda.. and Nazareth & Calleia – Importação e Exportação, Lda.), informed of any changes to such data, in order to delete or rectify them without delay and in full compliance with the data protection legislation.
You will be fully responsible for any loss or damage caused to the Responsible Companies for data processing or to any third party caused by the transmission of wrong, inaccurate or incomplete information provided in the "Customer Contact Form".
LIMITATION OF DATA PROCESSING PURPOSES AND DATA RETENTION
Your personal data cannot be processed in any way that is contrary to the purposes provided for in paragraph V, without prejudice to further processing required for other legal purposes.
Your personal data will be kept for no longer than is necessary for the purposes for which they are processed or until you express it otherwise.
RIGHTS
a) You have the right to ask the controller to access your personal data, as well as to rectify or delete it ("right to be forgotten").
(b) You have the right to receive personal data relating to you as well as to the transmission of such data to another data controller ("Portability").
(c) You give your consent to the Responsible Companies and/or another entity to which the latter may have transmitted your personal data with your prior consent to implement adequate technical and organizational measures to ensure the necessary protection against unauthorized or unlawful data processing and against data loss, destruction or accidental damage.
(d) You have the right to oppose the processing of your data.
(e) You have the right to rectify, restrict the processing or delete your personal data.
(f)You have the right to withdraw your consent to the processing of your personal data at any time. Withdrawal of your consent does not compromise the lawfulness of the processing performed on the basis of the previously given consent.
(g) You have the right to be informed, without undue delay, when there is a breach of personal data likely to involve a high risk to your rights and freedom;
(h) You have the right to file a complaint with the competent data protection authorities.
(i) You have the right to request that the decisions solely taken on the basis of automated processing concerning you or which affect you significantly, which are based on your personal data, be taken by individuals and not just by computers, being able to express your own point of view and challenge the decision;

VIII- Costa & Filhos, Lda. and Nazareth & Calleia – Importação e Exportação, Lda., undertake to respect the confidentiality of the personal data provided in the “Customer Contact Form” and ensure the exercise of the rights of the respective data subjects.
IX- The contacts of the entity responsible for personal data processing or protection, if necessary, will be available from 25th May 2018 at www.lojadasmeias.pt.

The Customer/Data Subject hereby declares to agree with these terms and conditions and that the information provided is explicit, concise, transparent, understandable and easily accessible, using a clear and straightforward language.
The Customer/Data Subject hereby further declares to give his/her informed consent and expressly authorizes the collection and processing of his/her personal data in the precise terms herein laid down.
